Consumer Terms of Service
1. Who These Terms Are For
These Consumer Terms of Service ("Terms") apply to you if you have a Zcope consumer account at zcope.app/me ("Member Account"), or if you subscribe to a Publisher's newsletter, take a Publisher's assessment, or join a Publisher's member community — even without creating a Member Account. In these Terms, "you" or "Member" means an audience member using these surfaces; "Publisher" means the independent creator whose brand you're interacting with; "Zcope," "we," "us," or "our" means the platform.
If you also buy a digital product, your purchase is governed by our separate Buyer Terms — see Section 3.
2. How Zcope Fits In
Publishers use Zcope's technology to run their own newsletters, assessments, digital products, and communities. The content, products, assessments, and communities you interact with belong to the Publisher, not to Zcope. Zcope provides the underlying technology, your Member Account, and the AI-based safety screening described in Section 5 — we are not a party to your relationship with a Publisher, and we don't create, edit, or vouch for what a Publisher sends or sells.
3. Purchases
If you buy a digital product from a Publisher, that purchase is governed by our Buyer Terms, which you accept separately at checkout. In short: the Publisher is the seller and is solely responsible for the product, delivery, and any refund or guarantee; Zcope provides the checkout technology only. These Consumer Terms don't change or repeat anything in the Buyer Terms — if the two ever seem to conflict on a purchase-specific point, the Buyer Terms control.
4. Your Member Account
- Your Member Account uses email-based sign-in (a one-time code sent to your email — no password to manage).
- Keep the email address on your account accurate and current; it's how we and Publishers reach you and how you sign in.
- You're responsible for anything that happens under your account, so keep access to your email secure.
- You can close your Member Account at any time by contacting us at support@zcope.app. Closing your account does not automatically unsubscribe you from any Publisher's mailing list — use each email's unsubscribe link or contact the Publisher to be removed.
5. Member Conduct & Communities
When you participate in a Publisher's community — posting, commenting, or sharing content — you're bound by our Acceptable Use Policy in the same way a Publisher is. Please read it; the short version is: no illegal, hateful, or harmful content, and no content that endangers or exploits anyone.
A few things specific to member communities:
- The Publisher moderates their own community first. Each Publisher is responsible for day-to-day moderation of the community they host.
- We AI-screen content before it's public. Every post, comment, and image you submit is automatically screened for safety before it becomes visible to others. This is an extra layer, not a substitute for human judgment — screening decisions aren't perfect.
- You can appeal. If your content is removed and you believe that was a mistake — including a removal driven by our AI screening — you can appeal to appeals@zcope.app.
- Enforcement can limit or end your access. Repeated or serious violations of the Acceptable Use Policy can result in your posts being restricted, your community access being limited, or your Member Account being suspended or terminated, following the graduated enforcement approach described in the Acceptable Use Policy.
6. Age Requirement
You must be at least 13 years old to hold a Member Account or use these surfaces (16 or older where required by EU law, e.g., for consent to data processing). We do not knowingly permit anyone under 13 to use these surfaces, and we will close any account we learn belongs to someone under 13.
7. Privacy & the Cross-Brand Wall
Your activity with one Publisher — what you subscribed to, purchased, or posted — is walled off from every other Publisher on Zcope. That separation is a core feature of your Member Account, not a courtesy: no Publisher can see your activity with a different Publisher.
That wall applies between Publishers. It doesn't mean Zcope itself has no visibility: as the platform operator, Zcope maintains an internal, global view of Member Account activity across brands for purposes like safety screening, fraud prevention, and account security, and — as with any online service — we may be legally required to disclose account information (for example, in response to a subpoena or a mandatory report such as a CSAM report to NCMEC), and such a legal disclosure could in principle draw on activity across more than one brand. This doesn't change the Publisher-facing wall described above; it's a limit on what Publishers can see, not a promise that no one at Zcope or no legal authority can ever see your full account picture.
For the full detail on what we collect, how we use it, who we share it with, and your rights, see our Privacy Policy.
8. Assessments & AI-Generated Content Aren't Professional Advice
Diagnostic assessments, quiz results, and any AI-generated insights or recommendations you receive through a Publisher's surfaces are for informational purposes only. They are not medical, mental-health, financial, or legal advice, and they're not a substitute for consulting a qualified professional. Publishers are responsible for how they present their own assessments and content, including any disclaimers required for their subject matter — but from your side as a Member, treat every result and every AI-generated suggestion as a starting point for your own judgment, not a diagnosis or a directive.
9. "As Is" / No Warranty
Zcope provides these surfaces "as is" and "as available," without warranties of any kind, to the maximum extent the law allows. We don't guarantee that a Publisher's content, assessment, or community will be accurate, uninterrupted, secure, or error-free.
10. Liability
To the maximum extent permitted by law, Zcope's total liability to you arising from your Member Account or your use of a Publisher's audience-facing surfaces (outside of a purchase, which is governed by the Buyer Terms) is limited to $50 or the amount you've paid directly to Zcope in the 12 months before the claim, whichever is greater (which will typically be $0, since these surfaces are free to Members). Nothing here limits liability that can't be limited by law.
11. Changes to These Terms
We may update these Terms from time to time, for example to reflect new features or changes in the law. If we make a material change, we'll give you notice (such as an in-product notice or an email to your account address) before the change takes effect. Continuing to use your Member Account after that point means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law provisions. If you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction whose laws grant you mandatory consumer protections, nothing in this section deprives you of those protections or of any right to bring proceedings in the courts of your place of residence.
